SCORCH MEDIA – TERMS OF SERVICE

These Terms of Service (“Terms”) govern all photography, videography, and digital content services provided by Scorch Media (“Company,” “we,” “us,” “our”) to the Client (“you,” “your”). By placing an order, booking services, or accepting delivery of content, you agree to these Terms.

1. SERVICES

Scorch Media provides professional photography, videography, drone services, and digital media services for real estate marketing, including but not limited to listing photography, video walkthroughs, social media content, virtual tours, and promotional media.

2. BOOKING & PAYMENT

  • All bookings are confirmed upon receipt of order placement.

  • Payment is due as stated on the invoice.

  • Late payments may be subject to additional fees and/or suspension of future services.

  • Prices are subject to change without notice for future bookings.

3. CANCELLATIONS & RESCHEDULING

  • Cancellations made within 24 hours of the scheduled appointment may be subject to a cancellation charge of up to 75% of the total order value.

  • No-shows may be charged up to 100% of the order value.

  • Adverse weather conditions may qualify for rescheduling at the discretion of Scorch Media with no additional fee.

  • Rescheduling requests must be made as early as possible.

4. CLIENT PREPARATION & DELAYS

The client is solely responsible for ensuring the property is fully photo-ready at the scheduled appointment time. This includes cleaning, staging, lighting, access, and removal of unwanted items.

If the property is not ready to shoot upon arrival, or if any delays occur at the scheduled start time due to the homeowner, tenant, or realtor, the client may be subject to an additional delay charge of $1 per minute until the shoot is able to begin.

Scorch Media is not responsible for reduced quality, shortened shoot time, or missed deliverables resulting from delayed access or incomplete preparation.

5. COPYRIGHT, LICENSING & MARKETING USAGE

All media created by Scorch Media remains the intellectual property of Scorch Media. Upon full payment, the client is granted a non-transferable, non-exclusive license to use the delivered content.

This license does NOT permit: Use in stock media, templates, resale products, or commercial resale without written consent.

The client grants Scorch Media full permission to use any and all media and content captured and created for the Company’s own website, marketing materials, portfolio, advertising, social media posts, promotional campaigns, and any other self-promotional purposes, without limitation or compensation, unless otherwise agreed to in writing.

6. REVISION POLICY

Minor editing adjustments will be considered within a reasonable timeframe after delivery. Revision requests exceeding the original scope of work may be subject to additional charges.

7. DRONE SERVICES

Drone operations are subject to weather conditions, local bylaws, airspace restrictions, and Transport Canada regulations. If drone operations are not legally or safely permitted at a location, aerial services may be canceled, rescheduled, or substituted at the discretion of Scorch Media without liability.

8. PROPERTY DAMAGE & LIABILITY

Scorch Media will take reasonable care while performing services but shall not be held liable for minor, incidental, or unavoidable damage unless caused by proven gross negligence.

9. CLIENT REPRESENTATION

The client confirms they have legal authority to grant access and permission for Scorch Media to photograph and record the property.

10. LIMITATION OF LIABILITY

Scorch Media’s total liability for any claim related to services rendered shall not exceed the total amount paid by the client for the specific order in question.

11. REFUNDS

Due to the custom nature of digital media services, refunds are not provided once the shoot has occurred and media has been delivered.

12. FORCE MAJEURE

Scorch Media shall not be liable for delays or failure to perform caused by circumstances beyond reasonable control, including but not limited to extreme weather, equipment failure, illness, government restrictions, or acts of nature.

13. AGREEMENT

These Terms constitute the entire agreement between Scorch Media and the Client. By placing an order, the client acknowledges they have read, understood, and agreed to these Terms.
